Watson & Co. Photography Terms & Conditions
These Terms & Conditions apply to all photography services provided by Watson & Co. Photography LTD (“the Photographer”). By paying a retainer or booking a session, the client (“the Client”) agrees to the following:
1. Booking, Retainer & Binding Agreement
A non-refundable retainer is required to secure any booking.
Payment of the retainer constitutes full acceptance of these Terms & Conditions and forms a legally binding agreement between the Client and the Photographer, whether or not a separate contract is signed.
No date, time, or services are confirmed until the retainer is received.
The retainer is credited toward the total session fee. The remaining balance must be paid in full by the agreed due date.
Late payments may incur additional charges. Additional services requested outside the original agreement may be invoiced separately.
2. Cancellations & Rescheduling
Cancellations made with 14 days’ notice or more release the Client from paying the remaining balance.
Cancellations made with less than 14 days’ notice require full payment.
Rescheduling requests will be accommodated where possible. Requests made with less than 48 hours’ notice may be treated as a cancellation.
Late arrivals reduce session time and do not qualify for refunds.
The Photographer may cancel or reschedule due to illness, emergency, unsafe conditions, or events outside their control. In such cases, liability is limited to rescheduling or refunding fees paid (excluding the retainer unless otherwise agreed).
3. Client Responsibilities
The Client is responsible for:
· Arriving on time and prepared
· Securing all necessary permissions, releases, and consents
· The conduct and consent of all participants
· Following reasonable instructions during the session
The Photographer is not responsible for dissatisfaction caused by styling choices, grooming, or participant behaviour.
4. Artistic Style & Editing
The Client acknowledges that photography is subjective. The Photographer’s artistic judgment, editing style, and image selection are final.
Disagreement with style, composition, or creative direction is not grounds for refunds or cancellation.
RAW or unedited files are never released under any circumstances.
5. Image Ownership & Usage
The Photographer retains full copyright and ownership of all images created.
The Client is granted a personal-use license to use delivered images for personal display and social media.
Commercial use (including advertising, business promotion, or paid partnerships) is permitted.
Resale is not permitted outside of digital sales. E.g. gallery prints, wall art or albums. This must only be done through the Photographer.
Unless the Client opts out in writing before the session, the Photographer may use images for portfolio, website, social media, and marketing purposes.
6. Image Delivery & Storage
Final edited images are delivered via online gallery within the agreed timeframe.
Images are archived for a limited period. The Client is responsible for downloading and backing up files. The Photographer is not liable for loss after the archive period ends.
7. Safety & Conduct
The Photographer may pause or end a session if conditions become unsafe or inappropriate.
The Photographer is not liable for injury or damage caused by unsafe behaviour, misuse of equipment, or failure to follow directions.
8. Sensitive Content & Consent
By booking, the Client confirms informed consent to the chosen style of photography.
For sessions involving sensitive subject matter (including boudoir or partial nudity), consent is explicitly acknowledged at the time of booking.
Clients under 18 must have a parent or legal guardian sign and be present. No nudity of any kind is permitted for under-18 participants.
The Photographer reserves the right to refuse any session that compromises safety, dignity, or legality.
9. Liability & Indemnity
The Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or liabilities arising from the session or image use.
The Photographer’s maximum liability is strictly limited to the total fees paid.
The Photographer is not liable for delays or failure to deliver caused by events outside reasonable control, including illness, equipment failure, or third-party service interruptions.
10. Data Protection
Client data and images are stored securely in accordance with UK GDPR and the Data Protection Act 2018.
Data is used solely for service delivery, business administration, and legal compliance. Images may be retained for archival purposes unless deletion is requested in writing.
11. Legal
These Terms are governed by the laws of England and Wales.
If any provision is found unenforceable, the remaining Terms remain in effect.
These Terms constitute the entire agreement between the Photographer and Client.
